STRIKEWELL BOXING AND PERFORMANCE PRIVACY POLICY
The Business collects, uses, processes, discloses and retains your personal information and data when you access or use the Business’s website or services. This Privacy Policy (“Policy”) discloses the privacy practices for www.strikewell.ca (the “Website”) of Henry Pham, dba Strikewell Boxing and Performance (“Business”, “we or “us”), as well as related products and services the Business may offer to you (collectively referred to as the “Services”). This Policy also explains how personal data and other information that the Business receives or collects about you may be collected or used and what rights you have as the User. The term “you” or “User” refers to any individual that accesses or uses the Website, or uses or purchases any of the Business’s Services.
This Policy is designed to be read in connection with our Terms of Use, which is available at [https://form.jotform.com/240775126554055] and applies to the Business as well as any service providers collecting, using, or disclosing personal information on behalf of the Business.
BY ACCESSING THE BUSINESS’S WEBSITE AND USING ITS SERVICES, YOU AGREE TO BE BOUND BY BOTH THE WEBSITE’S TERMS OF USE, AS WELL AS THIS POLICY.
1. DEFINITIONS
“Contact information” contact information that would enable an individual to be contacted at a place of business and includes name, position name or title, business telephone number, business address, business email or business fax number. Contact information is not covered by this policy.
“Personal Information” means information about an identifiable individual, e.g. name, age, home address, and phone number, payment or banking information, location data, device and network information such as IP address, browser type, unique device identifiers, advertising identifiers, other information that you provide us through your user account.
“Privacy Officer” means the individual designated responsibility for ensuring that the Business complies with this policy and its statutory obligations.

Unless the purposes for collecting personal information are obvious and the client, customer, member voluntarily provides his or her personal information for those purposes, we will communicate the purposes for which personal information is being collected, either orally or in writing, before or at the time of collection.
We will only collect customer information that is necessary to fulfill the following purposes:
- To verify identity;
- To identify customer preferences;
- To open and manage an account;
- To deliver requested products and services
- To enrol the client in a program;
- To ensure a high standard of service to our customers; and
- To meet regulatory requirements;
3. CONSENT
We will obtain customer consent to collect, use or disclose personal information (except where, as noted below, we are authorized to do so without consent).
Consent can be provided orally, in writing, electronically, or, it can be implied where the purpose for collecting using or disclosing the personal information would be considered obvious and the client, customer, member voluntarily provides personal information for that purpose. Consent may also be implied where a customer is given notice and a reasonable opportunity to opt-out of his or her personal information being used for physical or electronic mail-outs, the marketing of new services or products, fundraising and the customer does not opt-out.
- Subject to certain exceptions (e.g., the personal information is necessary to provide the service or product, or the withdrawal of consent would frustrate the performance of a legal obligation), customers can withhold or withdraw their consent for the Business to use their personal information in certain ways. A customer’s decision to withhold or withdraw their consent to certain uses of personal information may restrict our ability to provide a particular service or product. If so, we will explain the situation to assist the customer in making the decision.
- We may collect, use or disclose personal information without the customer’s knowledge or consent in the following limited circumstances:
- When the collection, use or disclosure of personal information is permitted or required by law;
- In an emergency that threatens an individual's life, health, or personal security;
- When the personal information is available from a public source (e.g., a telephone directory);

4. DATA OF THIRD PARTIES
The Website is intended for people who are at least nineteen (19) years of age. We will not knowingly collect Personal Data from any user under the age of nineteen (19) without the consent of their parent or guardian. If a child under the age of nineteen (19) has provided us with Personal Data, a parent or guardian of that child may contact us and request that such information be deleted from our records and that we terminate any corresponding subscription that was created. In addition, if we become aware that we have collected Personal Data from a child under the age of nineteen (19) without parental or guardian consent, we will take steps to remove that Personal Data from our servers.
If you are providing the Personal Data of any third parties, whether they are under the age of nineteen (19) or otherwise, including in connection with your use of the Website and the Services or purchase of our products, you are responsible for obtaining the third party’s consent to the collection, use and disclosure of their Personal Data in accordance with the terms of this Policy, and you hereby represent and warrant that you have such consent.
5. USING AND DISCLOSING PERSONAL INFORMATION
We will only use or disclose customer personal information where necessary to fulfill the purposes identified at the time of collection or for a purpose reasonably related to those purposes such as:
- To conduct customer surveys in order to enhance the provision of our services; and
- To contact our customers directly about products and services that may be of interest.
We will not use or disclose customer personal information for any additional purpose unless we obtain consent to do so.
We will not sell customer lists or personal information to other parties.
6. RETAINING PERSONAL INFORMATION
If we use customer personal information to make a decision that directly affects the customer we will retain that personal information for at least one year so that the customer has a reasonable opportunity to request access to it and in any case only so long as necessary to fulfill the identified purposes or a legal or business purpose.
The Business may retain Personal Data for a longer period if you provide such consent to the Business.
7. ENSURING ACCURACY OF PERSONAL INFORMATION
We will make reasonable efforts to ensure that customer personal information is accurate and complete where it may be used to make a decision about the customer or disclosed to another organization.
Customers may request correction to their personal information in order to ensure its accuracy and completeness. A request to correct personal information must be made in writing and provide sufficient detail to identify the personal information and the correction being sought. A request to correct personal information should be forwarded to the designated individual as identified under this Policy.
If the personal information is demonstrated to be inaccurate or incomplete, we will correct the information as required and send the corrected information to any organization to which we disclosed the personal information in the previous year. If the correction is not made, we will note the customers’ correction request in the file.

8. SECURING PERSONAL INFORMATION
We are committed to ensuring the security of customer personal information in order to protect it from unauthorized access, collection, use, disclosure, copying, modification or disposal or similar risks. The following security measures will be followed to ensure that customer personal information is appropriately protected:
- the use of locked filing cabinets;
- physically securing offices where personal information is held;
- the use of user IDs, passwords, encryption, firewalls;
- restricting employee access to personal information as appropriate (i.e., only those that need to know will have access.
We will use appropriate security measures when destroying customer’s, personal information such as:
- shredding any physical documents; and
- ensuring irrecoverable deletion of electronically stored information.
We will continually review and update our security policies and controls as technology changes to ensure ongoing personal information security.
9. THIRD PARTY APPLICATIONS OR WEBSITES
The Website may include links to, embedded content of, or rely upon the services of other applications or websites that are controlled by third parties. The Organizer does not monitor or control any such third-party provider, and we are not responsible for any of the content, user terms, or privacy policies for such applications and/or websites. YOU ARE STRONGLY ADVISED TO READ THE TERMS AND POLICIES OF ALL APPLICATIONS AND WEBSITES PRIOR TO VISITING SAME.

10. PROVIDING CLIENTS, CUSTOMERS, MEMBERS ACCESS TO PERSONAL INFORMATION
Customers have a right to access their personal information, subject to limited exceptions, which may include, but are not limited to:
- solicitor-client privilege,
- disclosure would reveal personal information about another individual,
- disclosure would reveal confidential commercial information that, reasonably, could harm the competitive position of the Business;
- and health and safety concerns.
A request to access personal information must be made in writing and provide sufficient detail to identify the personal information being sought. A request to correct personal information should be forwarded to the designated individual as identified under this Policy.
Upon request, we will also tell customers how we use their personal information and to whom it has been disclosed if applicable.
We will make the requested information available within 30 business days, or provide written notice of an extension where additional time is required to fulfill the request. A minimal fee may be charged for providing access to personal information. Where a fee may apply, we will inform the customer of the cost and request further direction from the customer on whether or not we should proceed with the request.
If a request is refused in full or in part, we will notify the customer in writing, providing the reasons for refusal and the recourse available to the customer.

We suggest you review this Policy and the Terms of Use frequently.
YOUR CONTINUED USE OF THE WEBSITE AND/OR SERVICES CONSTITUES YOUR CONSENT TO BE BOUND BY THIS AGREEMENT AND THE TERMS OF USE.
